TERMS AND CONDITIONS OF SALE
Enchanted Coliving, a French simplified joint-stock company (société par actions simplifiée unipersonnelle) with share capital of €1,000, registered office at 13 rue de la Trézence, Les Rollets, 17380 Nachamps, France, registered with the Trade and Companies Register (RCS) under number 99323416000014 (the “Company” or “we”), operates a coliving space offering furnished private rooms and shared living and working spaces to remote workers and digital nomads (the “Guest” or “you”).
These Terms and Conditions of Sale (the “Terms”) govern every booking made with the Company, whether directly, by e-mail, or through the Company's website or any third-party booking platform. Placing a booking constitutes full and unconditional acceptance of these Terms.
Article 1 – Purpose and Legal Qualification
These Terms govern the rental of a furnished private room and access to shared spaces within the Enchanted Coliving premises located at 13 rue de la Trézence, Les Rollets, 17380 Nachamps (the “Premises”), for a fixed, temporary stay.
The stay does not constitute the Guest's principal residence within the meaning of Article 2 of Act n° 89-462 of 6 July 1989. This booking is therefore a seasonal furnished letting (location meublée saisonnière) governed by the general contract provisions of the French Civil Code (Articles 1101 et seq.) and, as applicable, the French Consumer Code, and not by the 1989 Act on residential tenancies. By booking, the Guest confirms that the Premises will not be used as their principal residence in France.
Article 2 – Booking and Contract
A request for a stay becomes a binding contract only once (i) the Company has confirmed the booking in writing and (ii) the deposit referred to in Article 3 has been received in full. Prior to booking, the Guest receives all pre-contractual information required under Article L. 111-1 of the French Consumer Code (description of the room and services, price, duration, payment terms, and cancellation policy). The booking is personal to the Guest and may not be transferred without the Company's prior written consent.
Article 3 – Rate, Deposit and Payment Terms
The total price of the stay is stated in the booking confirmation. A deposit (“acompte”) equal to 50% of the total price is due at the time of booking and must be paid by bank transfer. The parties expressly agree that this sum constitutes a deposit. This is non refundable if the guest cancels outside of the booking policy.
The remaining 50% balance is due by bank transfer no later than seven (7) days before the arrival date. Failure to pay the balance by this deadline is treated as a cancellation by the Guest, and Article 5.2 applies. All payments must be made in euros, net of any bank charges, to the account stated in the booking confirmation.
Article 4 – Minimum Stay and Arrival Days
The minimum length of stay is fourteen (14) nights; no booking for a shorter period is accepted. For organisational reasons, arrivals take place on Sundays only, unless otherwise agreed.
Article 5 – Cancellation, Modification and No-Show Policy
5.1 Cancellation more than 60 days before arrival the amount paid will be refunded in full.
5.2 Cancellation is between 60 and 7 days before arrival: the deposit (50%) is retained by the Company in all cases as agreed compensation for the reservation of the room. Any balance already paid is refunded in full.
5.3 Cancellation 7 days or less before arrival, or no-show: the full price of the stay remains due in its entirety and is not refunded, including where the balance under Article 3 has not yet been paid. This amount constitutes agreed compensation (clause pénale, Article 1231-5 of the French Civil Code) for the loss suffered by the Company as a result of the room being unavailable to other guests at short notice.
5.4 Any early departure or shortening of the stay after arrival does not give rise to any refund.
5.5 Should the Company be required to cancel a confirmed booking for reasons attributable to it, the Guest will be offered, at their choice, a stay at the coliving on a different time period or a full refund of all sums paid, without further compensation.
5.6 The Company recommends that Guests take out appropriate travel/cancellation insurance.
Article 6 – Right of Withdrawal
In accordance with Article L. 221-28, 12° of the French Consumer Code, the statutory 14-day right of withdrawal applicable to distance contracts does not apply to accommodation services provided at a specified date. The cancellation terms of Article 5 therefore apply exclusively from confirmation of the booking.
Article 7 – Check-in and Check-out
Check-in takes place on Sundays starting at 14:00. Check-out takes place on the departure date by the time agreed with the company owner or staff. In accordance with the Company's obligations applicable to tourist accommodation, the Guest must present a valid identity document upon arrival for the register of occupants.
Article 8 – Code of Conduct and House Rules
By staying at Enchanted Coliving, the Guest agrees to the following principles, which form an integral part of these Terms:
Respect and inclusivity – Enchanted Coliving is a welcoming and diverse community. Any discrimination, harassment or hateful conduct based on origin, sex, gender identity, sexual orientation, disability, religion or any other ground protected under Articles 225-1 and 225-2 of the French Penal Code is strictly prohibited.
House Rules – a detailed set of House Rules (quiet hours, use of shared spaces, visitors, smoking policy, waste sorting, security) is provided to each Guest on arrival and forms an integral part of the contract.
Compliance with French law – Guests must at all times comply with applicable French law, including rules on noise disturbance and public order. The possession or use of illegal substances on the Premises is strictly forbidden.
Care of the Premises – Guests must take reasonable care of the Premises, furniture and equipment, promptly report any damage, and are liable for damage caused intentionally or through negligence, beyond normal wear and tear.
Article 9 – Right to Terminate the Stay
In the event of a serious or repeated breach by the Guest of these Terms, the House Rules or applicable law – including violence, harassment, discriminatory behaviour, illegal activity, or conduct seriously disturbing the peaceful enjoyment of other residents – the Company reserves the right to immediately terminate the stay and require the Guest to vacate the Premises, without notice and without refund of any sums paid or due, without prejudice to the Company's right to claim compensation for any damage suffered.
Article 10 – Liability and Insurance
The Guest is responsible for their personal belongings; the Company cannot be held liable for loss, theft or damage to personal property, except in case of proven fault by the Company. The Guest is strongly advised to hold personal (civil) liability and health insurance valid in France for the duration of the stay. Save in cases of gross negligence, wilful misconduct, death or personal injury, the Company's liability is limited to direct, proven damage and shall not exceed the total price paid for the stay.
Article 11 – Force Majeure
Neither party is liable for any failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code. In such a case, the Company will, where possible, offer to reschedule the stay or refund the sums paid for the affected period, less any amount already committed to third-party suppliers.
Article 12 – Personal Data
The Company processes the Guest's personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act of 6 January 1978, as amended, in order to manage the booking and stay and to comply with its legal obligations (including the register of occupants). The Guest may exercise their rights of access, rectification, erasure and objection by writing to stay@enchantedcoliving.com
Article 13 – Complaints and Consumer Mediation
Any complaint should first be addressed to the Company at stay@enchantedcoliving.com
In accordance with Articles L. 616-1 and R. 616-1 of the French Consumer Code, if no satisfactory solution is reached within 30 days, a Guest acting as a consumer may refer the dispute, free of charge, to the consumer mediator.
Article 14 – Governing Law and Jurisdiction
These Terms are governed by French law. The parties will first seek an amicable resolution of any dispute. Failing this, and subject to any mandatory consumer-protection rules granting jurisdiction to the courts of the Guest's domicile, exclusive jurisdiction is given to the courts within the jurisdiction of the Company's registered office (Charente-Maritime).
Article 15 – Acceptance
Any booking constitutes full and unreserved acceptance of these Terms and of the House Rules by the Guest.
